Terms of Service

By accessing or using SitePolaris (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users of SitePolaris, including free accounts and paid subscribers. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance.

SitePolaris provides website uptime monitoring, SSL certificate monitoring, domain expiry monitoring, performance tracking, security scanning, and related alert services for websites you specify. We monitor the URLs you add to your account at intervals defined by your subscription plan. The Service is provided "as is" and we make commercially reasonable efforts to maintain high availability, but we do not guarantee uninterrupted service. Features available depend on your subscription plan. We reserve the right to add, modify, or remove features with reasonable notice.

You are responsible for maintaining the confidentiality of your account credentials. You must immediately notify us at legal@sitepolaris.com if you suspect unauthorized access. You represent that: (a) all information you provide is accurate and current; (b) you are at least 18 years old; (c) you have the legal authority to enter into these Terms. You may only monitor websites and domains that you own or have explicit permission to monitor from the website owner. Monitoring websites without authorization is prohibited. One person or legal entity may not maintain more than one free account. Creating multiple free accounts to circumvent plan limits is prohibited.

Paid plans are billed monthly. Billing occurs on the same calendar date each month from the date you upgraded. Payments are processed securely by Razorpay. All prices are in USD unless otherwise stated. We reserve the right to change pricing with 30 days' notice to existing subscribers. You may cancel your subscription at any time from Account Settings. Cancellation takes effect at the end of the current billing period. We offer a 14-day money-back guarantee — if you are not satisfied within 14 days of purchase, go to Dashboard → Billing → Payment History and click "Request Refund" next to your payment. We process refunds within 2–3 business days. After 14 days, we do not provide pro-rated refunds for partial billing periods, except where required by applicable law. If a payment fails, we will retry the charge. If payment remains outstanding after 7 days, your account may be downgraded to the Free plan until payment is resolved.

You agree not to use SitePolaris to: • Monitor websites you do not own or have permission to monitor • Conduct denial-of-service attacks or any activity that disrupts monitored services • Attempt to gain unauthorized access to SitePolaris systems • Reverse-engineer, decompile, or attempt to extract the source code of the Service • Resell or sublicense access to the Service without written permission • Submit false information or impersonate another person or entity • Use the Service for any unlawful purpose or in violation of any applicable laws • Circumvent plan limits through automation, account sharing, or other means • Transmit viruses, malware, or any harmful code We reserve the right to suspend or terminate accounts that violate these provisions without prior notice.

SitePolaris and its content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Service without our written consent. You retain ownership of the data you input into SitePolaris (such as your monitor configurations and URLs). You grant us a limited license to process this data solely to provide the Service.

To the maximum extent permitted by applicable law, SitePolaris shall not be liable for: (a) any indirect, incidental, special, consequential, or punitive damages; (b) loss of profits, data, or goodwill; (c) service interruptions or monitoring failures; (d) any damages resulting from unauthorized access to your account. Our total liability to you for any claims arising under these Terms shall not exceed the total amount you paid to SitePolaris in the 3 months preceding the claim. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence.

The Service is provided "as is" without warranty of any kind. We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) all monitoring checks will be delivered; (c) alert notifications will be received in real time. Monitoring results are for informational purposes. SitePolaris is not responsible for any business impact resulting from website downtime, SSL expiry, or domain expiry, whether or not a notification was sent.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India. If you are a consumer in a jurisdiction with mandatory consumer protection laws, those laws may give you additional rights that these Terms cannot override.

You may terminate your account at any time from Account Settings. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
